Terms and Conditions – Produify POS Software

By accessing and using the Produify point of sale software (“Produify”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the software.

1. License

Produify grants you a limited, non-exclusive, non-transferable, and revocable license to use the software solely for managing your business operations in accordance with these Terms and Conditions.

2. Restrictions

You agree not to:

• Modify, copy, adapt, translate, or create derivative works from the software.
• Reverse engineer, decompile, or attempt to extract the source code of the software.
• Attempt to gain unauthorized access to the software, servers, databases, or related systems and networks.
• Use the software for any unlawful, fraudulent, or unauthorized purpose.
• Resell, sublicense, rent, or distribute the software without prior written permission from Produify.

3. Subscription and Payment

Use of Produify may require payment of subscription or service fees as described on Produify or in a separate subscription agreement.

You agree to:

• Pay all applicable fees on time.
• Provide accurate billing information.
• Understand that failure to pay may result in suspension or termination of access to the software.

All payments are non-refundable unless otherwise stated by Produify or required under applicable Moroccan law.

4. Data and Privacy

Produify may collect and process business and user data necessary to provide and improve the service. By using the software, you consent to such processing in accordance with applicable data protection laws in Morocco.

Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their accounts.

5. Disclaimer of Warranty

The software is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

Produify disclaims all warranties, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Availability or uninterrupted operation of the service

Produify does not guarantee that the software will be error-free or continuously available.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Produify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits
• Loss of business opportunities
• Data loss
• Business interruption

arising from or related to the use or inability to use the software, even if Produify has been advised of the possibility of such damages.

7. Termination

Produify reserves the right to suspend or terminate access to the software at any time, with or without notice, if a user violates these Terms and Conditions or uses the software unlawfully.

Upon termination, your right to use the software will immediately cease.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising from or related to these terms shall fall under the exclusive jurisdiction of the competent courts of Morocco.

9. Changes to Terms

Produify reserves the right to update or modify these Terms and Conditions at any time. Continued use of the software after changes become effective constitutes acceptance of the updated terms.
